01 Engagement Authorization
By requesting a Security Audit or Penetration Test, the Client explicitly authorizes Wind X Tech to perform security testing on the specified assets. The Client represents that they have the legal right to authorize such testing and shall indemnify Wind X Tech against any third-party claims arising from unauthorized testing targets provided by the Client.
02 Acceptable Use of SaaS Tools
Users of Wind X Tech scheduling and automation applications agree not to use the services for any malicious activity, including but not limited to: unauthorized scanning, spamming, or attempting to circumvent application security controls. Any detected breach of this protocol will result in immediate termination of the service.
03 Limitation of Liability
Wind X Tech provides IT and security services on an "as-is" basis. While we strive for 100% vulnerability detection, security is a moving target. Wind X Tech is not liable for any security breaches, data loss, or system downtime occurring on assets managed or audited by us, particularly those resulting from zero-day exploits or pre-existing misconfigurations.
04 Confidentiality & Non-Disclosure
Wind X Tech maintains strict confidentiality regarding all Client data, network architectures, and vulnerability findings discovered during the course of work. Such information will never be shared with third parties except as required by Aruban law.
05 Managed Services (NinjaOne/Cloudflare)
For clients utilizing remote management tools, Wind X Tech is responsible for the configuration and deployment of agreed-upon policies. The Client remains the owner of the underlying hardware and is responsible for physical security and end-user compliance with internal company policies.
06 Governing Law
These terms are governed by the laws of Aruba. Any disputes arising from this agreement shall be settled within the jurisdiction of Oranjestad, Aruba.
End of Protocol. Proceeding with payment or project kickoff constitutes acceptance of these terms.
